The firm obtained summary judgment on behalf of client Behrooz Salim in Saud v. Salim, et al., Case Number SC122618, Santa Monica, Judge Nancy Newman. Salim purchased a $7 million home in Beverly Hills, but Saudi Arabian Princess Seeta bint Abdulaziz Al Saud claimed she owned and never sold the property. The Princess sued Salim for ejectment and quiet title. Litigation in the case spanned three different Federal and State courts and several years. The Firm eventually filed a motion for summary judgment on the grounds that the Princesses’ action was barred by the three year statute of limitations governing quiet title actions based in fraud. The Court agreed with the Firm and granted summary judgment in favor of Salim, which ended the dispute and allowed Salim and his family to keep the Beverly Hills property.

Devin McRae was recently quoted in Michael Corkery and Stacy Cowley’s New York Times piece “Wells Fargo Killing Sham Account Suits by Using Arbitration.” Devin represents Mexican music star Ana Bárbara, whom was a victim of massive theft by a bank employee and is one of the thousands of Wells Fargo customers suing the bank for using personal information to create fake, unauthorized accounts. According to Devin, the case of Wells Fargo’s abuses towards its customers should be reviewed in open court, not in arbitration.
“I think it’s a major problem when you have a bank that is so large, doing the things that Wells Fargo did on a systematic basis, to be able to keep that under wraps,” Mr. McRae said.

Bryan Sullivan was recently asked by The Wrap to comment on what effect Donald Trump’s presidency could have on the First Amendment. According to Bryan, there’s not much Trump can do to change the Constitution.
“Honestly I really don’t think there really is much of a worry,” Bryan said. “If reporters do their jobs the way its supposed to be done, they shouldn’t have anything to worry about.”

A class action lawsuit (Johnson v. Sun West Mortgage Company, Inc., et al., Case Number BC541571, Los Angeles Superior Court, Honorable John Shepard Wiley) was filed against our client, Sun West Mortgage Company, alleging that the company, as a reverse mortgage servicer, would obtain excessively priced lender placed insurance for its borrowers in exchange for various alleged kickbacks from insurers, and allegedly improperly backdated those policies even if there was no evidence of damage to the property being insured. On behalf of Sun West, the Firm filed a motion for summary judgment as to all five claims. The Court agreed with Sun West and granted the motion in its entirety. The Court found that class plaintiff Johnson provided no evidence to support his unsubstantiated claims, and that Johnson failed to provide any evidence to support his or the class’s theories that Sun West and Proctor Financial Inc. received “kickbacks” or commissions.

Bryan Sullivan was recently quoted in Brian Flood’s The Wrap article “Will Chris Christie’s Prosecutor Pal Go After the New York Times Over Trump’s Taxes?” which discusses whether the publication could be successfully sued for publishing Donald Trump’s tax returns if they were “illegally obtained.” According to Bryan, while there has been speculation that New Jersey Attorney General Christopher Porrino could bring charges against the Times, it’s not likely.
“I’m sure many people will cite the fact that he’s Christie’s friend and Christie’s relationship with Trump and that it’s all political,” Bryan said. “My experience with state attorney generals is that they really try to do their job because state attorney generals want to have a political future.”

Devin McRae was recently quoted in Anousha Sakoui and Lucas Shaw’s Bloomberg article “Fox Accuses Netflix of Poaching Employees in California Suit” and Matthew Blake’s Los Angeles Daily Journal article “Fox’s poaching suit against Netflix stirs questions.” According to Devin, the lack of detail in the complaint may make it difficult for Fox to prove its allegation that Netflix knowingly poached employees with fixed-term contracts.
“There really are no facts pleaded,” Devin told the Daily Journal. “Let’s wait and see if there are facts that support it.”

Russell, was confirmed on appeal on what was essentially a matter of first impression.
